
Shiv Kumar assaulted a woman executive a year ago
Agreeing to the prosecution’s argument for awarding the maximum punishment provided under the amended law, a Fast Track court here on Tuesday sentenced Uber cab driver Shiv Kumar Yadav to imprisonment for his whole life, for sexually assaulting a woman executive last year.
“Keeping in view the totality of the facts and circumstances of the case, I am of the opinion that the interest of justice would be served, if convict Shiv Kumar Yadav is sentenced as under: for offences punishable under Section 376 (2) (m) of the IPC, the convict is sentenced to undergo rigorous imprisonment for life, which shall be imprisonment for the remainder of the convict’s natural life,’’ Additional Sessions Judge Kaveri Baweja said in her order of sentence.
Section 376 (2) (m) (while committing rape, endangering the life of a woman) of the Indian Penal Code, under which Yadav was charge-sheeted, provides for imprisonment for whole life.
Ms. Baweja also imposed a fine Rs.10,000 on the accused to be paid to the victim. The judge also ordered compensation for the victim to be decided by the Delhi Legal Services Authority.
Ms. Baweja had, on October 20, convicted Yadav under the IPC Sections 376 (2) (m), Section 366 (kidnapping a woman to cause her defilement), 506 (criminal intimidation), and 323 (voluntarily causing hurt).
The court also handed down various terms of imprisonment to Yadav under Sections 366, 506 and 323, but at the same time, the judge ordered that all the sentences would run concurrently.
The woman was raped at an isolated place by 32-year-old Yadav on the night of December 5 last year in his cab which she had hired to return home at Inderlok in North Delhi.
The Delhi police had arrested Yadav on December 7 in Mathura, two days after the incident. The trial began on January 15 and concluded on October 7.
